Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website emberlost.com and the browser game EMBERLOST (together, the "Service"), operated by TSD CONSULTANCY - FZCO, Dubai Silicon Oasis, Dubai, United Arab Emirates ("we", "us"). By using the Service you agree to these Terms.

1. The Service

EMBERLOST is currently offered free of charge, playable directly in your web browser, with no account required. Chapters are released over time; we may add, change, pause or remove content and features at our discretion. Mobile versions, when released, may be subject to additional store terms.

2. License to play

We grant you a personal, non-exclusive, non-transferable, revocable license to access and play EMBERLOST for private, non-commercial entertainment. You may not sell, sublicense, or commercially exploit the Service or its content, except as expressly allowed in Section 4.

3. Intellectual property

The Service — including the game, its code, art, logos, characters, music, sound, text and the EMBERLOST name and marks — is owned by us or our licensors and is protected by copyright, trademark and other laws. No rights are granted except the limited license above.

4. Videos, streams and screenshots

We welcome coverage: you may capture, stream and publish gameplay footage and screenshots of EMBERLOST (including monetized videos on platforms such as YouTube or Twitch), provided you do not claim the game as your own work and do not use the material in a misleading, defamatory or unlawful context. Press assets are available in our press kit.

5. Acceptable use

• Do not interfere with or disrupt the Service, our servers or other players' use of it.
• Do not attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Do not scrape, mass-download or redistribute the Service's assets outside the uses allowed above.
• Do not use the Service in violation of applicable law.

6. Saves and availability

Game progress is stored locally in your browser; clearing browser data will erase it. The Service is provided without any commitment to uninterrupted availability, and we may suspend it for maintenance or updates at any time.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. AS THE SERVICE IS FREE, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO IT SHALL NOT EXCEED FIFTY (50) US DOLLARS. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Privacy

Our handling of information is described in the Privacy Policy. In short: no analytics, no ads, no accounts; the optional newsletter is double opt-in.

10. Changes to these Terms

We may update these Terms from time to time. The current version is always available at this address with its "last updated" date. Continued use of the Service after a change constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws applicable in the Emirate of Dubai, United Arab Emirates, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence remain unaffected.
